Kullanım Koşulları Terms of Use

Elvador platformuna erişim ve kullanım koşullarını, kullanıcı sorumluluklarını ve hizmet sınırlarını açıklar. Explains access to and use of the Elvador platform, user responsibilities, and service limitations.

1. Giriş ve Kabul

elvador.com web sitesine ve Elvador yapay zeka yazılımına ("Platform") hoş geldiniz. Bu Platform, Talha Türkman ("Hizmet Sağlayıcı", "Biz") tarafından sağlanmaktadır.

Bu Platforma erişerek veya kullanarak, işbu Kullanım Koşullarını ("Koşullar") okuduğunuzu, anladığınızı ve bu Koşullara yasal olarak bağlı olduğunuzu kabul edersiniz. Bu Koşulları kabul etmiyorsanız, Platformu kullanmamalısınız.

2. Hizmetlerin Tanımı

Elvador, otel misafirlerine ve potansiyel misafirlere yönelik (rezervasyon, bilgi alma, canlı destek talebi vb.) konularda yardımcı olmak üzere tasarlanmış bir yapay zeka asistanıdır.

3. Hesap Güvenliği ve Kullanıcı Sorumlulukları (Otel Misafirleri)

Platformun otel misafirlerine özel bölümlerine erişim, size tahsis edilen "Misafir Numarası" ve "Oda Numarası" ile sağlanır. Bu bilgilerin gizliliğini korumak tamamen sizin sorumluluğunuzdadır. Bu bilgiler kullanılarak yapılan tüm işlemlerden siz sorumlu kabul edilirsiniz. Bilgilerinizin yetkisiz kullanımını fark ettiğiniz anda derhal bizi bilgilendirmelisiniz.

4. Yasaklı Aktiviteler

Platformu kullanırken aşağıdakileri yapmayacağınızı kabul edersiniz:

  • Platformu herhangi bir yasa dışı amaçla veya yerel, ulusal, uluslararası yasaları ihlal edecek şekilde kullanmak.
  • Hakaret, küfür, iftira, müstehcenlik, taciz veya nefret söylemi içeren içerikler üretmek veya iletmek.
  • İstenmeyen ticari mesajlar (spam) göndermek veya sistem aracılığıyla toplu mesajlaşma yapmak.
  • Platformun altyapısına makul olmayan veya orantısız büyüklükte bir yük bindirmek (DDoS saldırıları dahil) veya hizmeti kesintiye uğratmaya çalışmak.
  • Platformun (Elvador yazılımının) kaynak kodunu çıkarmaya çalışmak, tersine mühendislik yapmak, deşifre etmek veya kopyalamak.
  • Virüs veya diğer zararlı yazılımları sisteme bulaştırmaya çalışmak.
  • Başka bir kişinin veya kurumun kimliğine bürünmek.

5. Fikri Mülkiyet Hakları

Elvador yazılımının kendisi, arayüzü, algoritmaları ve Platformda yer alan tüm içerikler (kullanıcı tarafından oluşturulanlar hariç) Talha Türkman'ın münhasır mülkiyetindedir ve fikri mülkiyet yasalarıyla korunmaktadır. Size yalnızca Platformu bu Koşullar dahilinde kullanmanız için sınırlı, devredilemez bir kullanım lisansı verilmektedir.

6. Hizmetin Askıya Alınması ve Sonlandırılması

Biz, kendi takdirimize bağlı olarak, bu Koşulların (özellikle "Yasaklı Aktiviteler" bölümünün) ihlal edilmesi durumunda veya herhangi bir yasal zorunluluk nedeniyle, önceden bildirimde bulunmaksızın Platforma erişiminizi derhal askıya alma veya sonlandırma hakkını saklı tutarız.

7. Garanti Reddi ve Sorumluluğun Sınırlandırılması (Önemli)

Platform (ve yapay zeka asistanı Elvador) size "OLDUĞU GİBİ" ve "ELVERİŞLİ OLDUĞU KADARIYLA" sunulmaktadır.

Yapay zekanın verdiği yanıtların, sağladığı bilgilerin (rezervasyon detayları, otel olanakları, fiyatlandırma vb. dahil) doğruluğu, eksiksizliği, güvenilirliği veya güncelliği konusunda hiçbir açık veya zımni garanti vermemekteyiz.

Yapay zeka sistemleri hatalar yapabilir, yanlış veya eksik bilgi verebilir. Platformdan aldığınız bilgilere dayanarak herhangi bir işlem yapmadan önce (örneğin bir rezervasyonu kesinleştirmeden veya ödeme yapmadan önce) bu bilgileri bağımsız bir kaynaktan veya doğrudan otel personeli aracılığıyla teyit etmek tamamen kullanıcının sorumluluğundadır.

Platformun kullanımından kaynaklanan (hatalı bilgi, hizmet kesintisi vb.) hiçbir doğrudan veya dolaylı zarardan Hizmet Sağlayıcı sorumlu tutulamaz.

8. Koşullarda Değişiklik

Bu Kullanım Koşullarını zaman zaman güncelleme hakkımızı saklı tutarız. Değişiklikler bu sayfada yayınlandığı an yürürlüğe girer. Platformu kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.

9. Uygulanacak Hukuk

Bu Koşullar, Türkiye Cumhuriyeti kanunlarına tabi olacak ve bu kanunlara göre yorumlanacaktır. Bu Koşullardan kaynaklanan uyuşmazlıklarda Bursa Mahkemeleri ve İcra Daireleri yetkilidir.

1. Introduction and Acceptance

Welcome to the elvador.com website and the Elvador artificial intelligence software ("Platform"). This Platform is provided by Talha Türkman ("Service Provider", "We", "Us").

By accessing or using this Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Platform.

2. Description of Services

Elvador is an artificial intelligence assistant designed to assist hotel guests and potential guests with matters such as reservations, information retrieval, live support requests, etc.

3. Account Security and User Responsibilities (Hotel Guests)

Access to the hotel guest-specific sections of the Platform is provided using your assigned "Guest Number" and "Room Number". You are solely responsible for maintaining the confidentiality of this information. You are considered responsible for all activities that occur using this information. You must notify us immediately upon becoming aware of any unauthorized use of your information.

4. Prohibited Activities

By using the Platform, you agree not to:

  • Use the Platform for any illegal purpose or in violation of any local, national, or international laws.
  • Generate or transmit content that is defamatory, obscene, harassing, abusive, or constitutes hate speech.
  • Send unsolicited commercial messages (spam) or engage in bulk messaging through the system.
  • Impose an unreasonable or disproportionately large load on the Platform's infrastructure (including DDoS attacks) or attempt to disrupt the service.
  • Attempt to extract the source code of the Platform (Elvador software), reverse engineer, decompile, or copy it.
  • Attempt to infect the system with viruses or other malicious software.
  • Impersonate any other person or entity.

5. Intellectual Property Rights

The Elvador software itself, its interface, algorithms, and all content on the Platform (excluding user-generated content) are the exclusive property of Talha Türkman and are protected by intellectual property laws. You are granted only a limited, non-transferable license to use the Platform in accordance with these Terms.

6. Suspension and Termination of Service

We reserve the right, in our sole discretion, to suspend or terminate your access to the Platform immediately and without prior notice for any violation of these Terms (especially the "Prohibited Activities" section) or due to any legal requirement.

7. Disclaimer of Warranties and Limitation of Liability (Important)

The Platform (and the AI assistant Elvador) is provided to you "AS IS" and "AS AVAILABLE".

We provide no warranties, express or implied, regarding the accuracy, completeness, reliability, or timeliness of the responses given by the artificial intelligence or the information it provides (including but not limited to reservation details, hotel amenities, pricing, etc.).

Artificial intelligence systems can make mistakes and may provide incorrect or incomplete information. It is solely the user's responsibility to verify any information obtained from the Platform (e.g., before finalizing a reservation or making a payment) through an independent source or directly with hotel staff.

The Service Provider shall not be liable for any direct or indirect damages arising from the use of the Platform (including erroneous information, service interruptions, etc.).

8. Changes to Terms

We reserve the right to update these Terms of Use from time to time. Changes become effective the moment they are posted on this page. Your continued use of the Platform signifies your acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Bursa Courts and Execution Offices.
